Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit the Ward Seven Fire Protection District of Bienville Parish (District) from awarding a contract to cut grass to Mr. Clint Robinson.
Facts:
An advisory opinion request from Rose Jackson regarding whether the Code of Governmental Ethics would prohibit the District from awarding a contract to cut the grass to Mr. Clint Robinson when the District did not adhere to La. 38:2214(a) regarding the proper procedure found in the Public Bid Laws.

Ms. Jackson provided that the District solicited bids for lawn care to be submitted by April 9, 2015. The bids were opened at the April 9, 2015 meeting and lowest bid was $25.00 per cut. Afterward, someone made a motion to re-advertise the bids with a closing date of May 7, 2015. At the May 7, 2015 meeting Mr. Robinson's bid was opened and found to be $24.99.

Law:
Section 601A of the Board Rules provide The board shall receive request for advisory opinions filed with it by affected persons. Request shall be in writing, state the name and address of the person requesting the advisory opinion, disclose the interest in the question presented state the governmental agency and/or the individual involved, specifically describe the transaction involved, be signed by the person making the request, and state sufficient facts to enable the board to respond. The board may decline to render an opinion with regard to any such request.

Recommendations:
Decline to render an advisory opinion.
