In connection with her request that the Board waive the late fee assessed for the late filing of the report, Timothy Ratcliff, CPA, report preparer for Theresa "Terri" Miles, states that the report was completed and filed timely, on November 14, 2014. However, he was unable to locate the EDE-P form needed so used the supplemental form to make sure it was not late because it was after office hours so he was unable to obtain help at the time of filing. Mr. Ratcliff further stated that he spoke with an Ethics staff member the following day and was told that she "would make a record of what happened and that it would probably be okay."
Thereafter, he received a letter stating the form was filed late. He immediately logged onto the system and filed the proper form. Due to the fact that he made every attempt to file the proper form timely, he requests that the late fee assessed to all parties in the committee be waived.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
