Request that the Board waive campaign finance late fees assessed against Gilbert Aucoin, a candidate for District Judge, 13th Judicial District Court, Evangeline Parish in the November 4, 2014 Election, whose 30-P campaign finance report was filed 22 days late, 10-P report was filed 1 day late, EDE-P report was filed 7 days late, 2014 supplemental report was filed 132 days late and 10-G report was filed 216 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Gilbert Aucoin states that his campaign chairman, Tosha LeBouef, provided him false information regarding complying with campaign disclosure and has been discharged as his employee as a result. Ms. LeBouef had been concealing the delinquency notices and representing to Mr. Aucoin that she was able to oversee/submit the reports easily. When asked, she would say that "everything was taken care of." Her hiding place where she maintained letters from Ethics was discovered when his new secretary assumed her position. Mr. Aucoin further stated that this was his first election and he relied on her representing her ability to submit the reports.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Decline to waive for the 30-P, 10-P reports.

Suspend all based on future compliance for the EDE-P report and the 10-G report.


Suspend all but $200 for the 2014 supplemental report. The fine is payable within 30 days or the suspended portion becomes due and owing.
