RE:
Request that the Board waive the $5,000 in campaign finance late fees assessed against Julian Parker, a candidate for District Judge, Orleans Parish in the September 21, 1996 Election, whose 2014 Supplemental campaign finance disclosure report was filed 98 days late, and whose 2014 Supplemental campaign finance disclosure report in the October 4, 2008 Election also was filed 98 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, William Clifton Stoutz, campaign manager and report preparer for Julian Parker, states that he did not receive any notifications regarding the late fees until he received the certified letter with the failure to file late fee order. Mr. Stoutz also stated that the same problem occurred last year and was paid, but he was under the belief that the problem would not recur because he provided all of the correct addresses to mail any notifications after no notification was sent to his office.

Campaign finance staff confirmed that reminder letters for both of the 2014 supplemental reports were mailed to the correct address.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all based on future compliance for the the 2014 supplemental report for the September 21, 1996 election.

Suspend all but $300 based on future compliance for the 2014 supplemental report for the October 4, 2008. The fine is payable within 30 days or the suspended portion becomes due and owing.
