RE:
Request that the Board waive the $660 campaign finance late fee assessed against Nanine McCool, a candidate for District Judge/22nd Judicial District, St. Tammany Parish in the November 4, 2014 Election, whose EDE-P campaign finance disclosure report was filed 11 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Nicole Gould, report preparer for Nanine McCool, states that there were no election day expenditures to report and because of the lack of activity, unfortunately, she assumed the report was optional.
The candidate attempted to follow every rule and has (mostly) a good track record in filing her reports. Moreover, the thinly financed candidate relied upon Ms. Gould's volunteer efforts to interpret the Louisiana campaign finance rules because of her legal expertise in tax. The board is asked to consider her de minimis campaign activity compared to the fine. Finally, the Board is asked to consider an e-alert system to notify candidates of missed reports.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all based on future compliance.
