Advisory opinion request regarding whether Chris Owens, Sr., a former employee of the Louisiana State Police, may own and operate a driving school in Louisiana.
Facts:
Mr. Owens is a former employee of the Louisiana State Police (LSP). The nature of the driving school Mr. Owens would like to operate includes classroom and behind-the-wheel driving education training and third party testing. Mr. Owens did not provide education training or testing while employed by the LSP and has never worked for the Louisiana Office of Motor Vehicles. The Louisiana Office of Motor Vehicles oversees the Louisiana driving school program.
Mr. Owens retired from the LSP in March of 2014. During his tenure with the LSP he served in both the patrol and narcotics divisions. He also served as the executive officer for Troop I, interim troop commander, and as a special operations supervisor. As the special operations supervisor during the last two years of service with the LSP, he was responsible for oversight of the criminal interdiction unit, accident reconstruction unit, motorcycle patrol unit, crash statistics and analysis, fatal, serious injury and fleet accident review, and emergency operations.

Law:
Section 1121B(1) of the Code provides that no former public employee shall, for two years following the termination of his public employment, assist another person for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
