Advisory opinion request regarding whether Hollins Trahan, Sr., can serve as a reserve officer with the Morse Police Department, in Acadia Parish, while he is a licensed bail bond agent.
Facts:
Hollins Trahan, Sr., a licensed bail bond agent, is the sole owner of Easy Out Bail Bonds. He stated that he would not perform services as a bail bond agent in his private capacity, including fugitive apprehension, in the Village of Morse or for any person who had been arrested by the Morse Police Department.

As a reserve officer, Mr. Trahan would perform police duties and assist with fugitive recovery in the Village of Morse. Additionally, the Morse Police Department does not have a bonding department.

Comments:
Pursuant to LAC 37:XIII:4903, a licensed bail bond agent is authorized to provide surety in Louisiana, and/or engages in the apprehension and return of persons who are released on bail or who failed to appear at any stage of the proceedings to answer the charge before the court in which they may be prosecuted.
Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of his agency and in which he has participated.

La. R.S. 42:1111C(2)(d) prohibits a public servant and any legal entity in which he exercises control or owns an interest in excess of twenty-five percent, from receiving any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are neither performed for nor compensated by any person that has substantial economic interests which may be substantially affected by the performance or nonperformance of his official duty.

La. R.S. 42:1113A prohibits a public servant, a member of his immediate family, or legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.

Recommendations:
Adopt the proposed advisory opinion.
