Advisory opinion request regarding whether Jeffery Lee, as the sole owner of French Quarter IT, LLC, may provide software development services for a "Training Treatment Database" to LSU Athletics.
Facts:
Jeffery Lee resigned his position as a computer manager with Auxiliary Services (AS) at Louisiana State University (LSU) on January 31, 2015. His job duties while employed with AS included creating and maintain databases and applications, creating and updating new and existing interfaces/programs between AS systems and other campus information systems, and assisting with vendor-based point of sale equipment and software in use by the LSU Dining, LSU Concessions, Dairy Store, Student Health Center, and Pennington Biomedical Research Center.
He would like to pursue assisting LSU Athletics with its Training Treatment Database. This project would not replace, replicate, or utilize any system or service provided by LSU AS. LSU Athletics is a separate agency from AS. According to Mr. Lee, AS does not provide or intend to provide software development service to LSU Athletics. Mr. Lee's software development responsibilities were directly associated with the LSU One Card program and departments within LSU Auxiliary Services.

Law:
La. R.S. 42:1121B(1) provides that no former public employee shall, for two years following the termination of his public employment, assist another person for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
