Advisory opinion request regarding whether the post employment restrictions prohibit Village of Atlanta Alderman Randall Hayes from accepting a position as the Editor of The Winn Parish Enterprise.
Facts:
Alderman Randall Hayes requested an advisory opinion regarding whether he may resign his position with the Village of Atlanta as Alderman and accept employment with The Winn Parish Enterprise within two years of his termination of his public office. The Winn Parish Enterprise is the official journal for the Parish. The Enterprise is the only newspaper of general circulation in the Winn Parish. The Village pays The Enterprise to print the minutes of the Village Board of Alderman meetings and other public notices.

Mr. Hayes provided that the Editor of The Enterprise does not handle the Board of Aldermen meeting minutes. Further, Mr. Hayes stated that the Editor is responsible for the news not any legal notices or classified ads.

Law:
La. R.S. 42:1121A(1) prohibits a former elected official, for a period of two years following the termination of his public service as an elected official serving in such agency, from assisting another person for compensation, in a transaction, or appearance in a connection with a transaction, involving that agency or rendering any service on a contractual basis to that agency.

Recommendations:
Adopt the proposed advisory opinion.
