RE:
Request that the board waive the $420 campaign finance late fee assessed against Barbara Freiberg, a candidate for East Baton Rouge Parish School Board, District 7, in the November 4, 2014 election, whose 2014 Supplemental campaign finance disclosure report was filed 7 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Barbara Freiberg states that she naively thought that she could handle her campaign reports without hiring someone to help her. She is now receiving assistance from Gene Dawson and the school board legal counsel.

She states that in December, 2014, she read over the reporting schedule and mistakenly determined that she did not owe a supplemental report because the description of who needed to file did not seem to apply to her situation. She thought the wording "candidates and PACs supporting or opposing with outstanding debts or loans or having additional contributions or expenditures" did not apply since she had not had additional contributions, had no outstanding debts, and had no additional expenses. After she was notified by the Ethics Board that she had a late filing, she realized that she was required to file the report and immediately did so.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 based on future compliance. The fine is payable within 30 days or the suspended portion becomes due and owing.
