RE:
Request that the board waive the $480 campaign finance late fee assessed against Brady O'Callaghan, a candidate for District Court Judge, 1st JDC, in the November 4, 2014 election, whose 2014 Supplemental report was filed 8 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, Susan Whitelaw, report preparer for Brady O'Callaghan, states that Mr. O'Callaghan was required to file two supplemental reports for two elections in 2013 and 2014. Final reports for both elections were filed in October, 2014. However, the Ethics Board called and explained that one last report for the 2014 election needed to be filed to close out a small loan issue. A 2014 supplemental report was immediately filed, but they received a letter from the Ethics Board on February 26, 2015 explaining that a report was filed for the 2013 election instead of the 2014 election. The correct campaign report was filed immediately upon the discovery of the issue.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
