Untimely waiver request submitted by James Adger, a member of the Caddo Parish Levee District, regarding a $1,500 late fee assessed for filing his 2012 Tier 2.1 annual pfd 31 days late.
Facts:
Prior to the Board directing the staff to no longer docket these types of waivers as the Board has determined that it will not consider untimely waiver request, the Board considered this matter and deferred the matter directing the staff to determine Mr. Adger's term of office. A request was sent to Mr. Adger and no response was received. A request was sent to the Caddo Levee District, which provided information stating that Mr. Adger's term of office did not end until 2013. Therefore, Mr. Adger was required to file a 2012 Tier 2.1 pfd.

Initial Information:


Mr. Adger's wife filed the waiver request stating that her husband, Mr. Adger suffered two strokes and was unable to timely file the paperwork. A request for supporting documentation regarding the Mr. Adger's medical issues was requested. A response was due by September 26, 2014. No response has been received. A staff member also spone with Ms. Adger informing her supporting documentation was needed.

Law:
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
