| Advisory opinion request regarding whether there is a conflict of interest in St. Mary School Board Superintendent Leonard Armato's brother, John Armato, having an ownership interest in Darnall, Sikes, Gardes, & Frederick (Sikes), which audits the School Board and whether Barrett Perry, who is the son of Alton Perry, the CFO of the School Board, has a conflict of interest as an employee of Sikes. |

John Armato has a four percent (4%) ownership interest in Sikes. The current contract to provide auditing services by Sikes for the School Board was perfected during January of 2015, six months prior to his brother Leonard Armato becoming Superintendent on June 8, 2015. John Armato is not performing the auditing services for the School Board.
Barrett Perry, son of Alton Perry, works in the Sikes office that is handling the audit but is not performing any work for the School Board audit. He has no ownership interest in Sikes.

La. R.S. 42:1113A(1)(a) prohibits a public servant, member of his immediate family, or legal entity in which he has a controlling interest from entering into any contract, subcontract or other transaction under the supervision or jurisdiction of the agency of such public servant.
La. R.S. 42:1114 requires a public servant or a member of his immediate family, who derives a thing of economic value, of which the immediate family member may be reasonably expected to know has bid on or entered into or is in anyway interested in any contract or any other transaction under the supervision of the public servant's agency to file a disclosure statement with the Board of Ethics stating the: (1) amount of income, (2) nature of the business, (3) name, address and relationship to the public servant, and (4) name and business address of the legal entity.
