Advisory opinion regarding whether Lindora Baker, member of the Caddo Parish Commission, may accept employment with a medical clinic owned by the Biomedical Research Foundation if she resigns from the Caddo Parish Commission.
Facts:
Lindora Baker is a member of the Caddo Parish Commission. Presently, a millage exists for the benefit of the Biomedical Research Foundation of Northwest Louisiana (the "Foundation"), a nonprofit corporation, that is distributed through the Caddo Parish Finance Department. The Caddo Parish Commission voted in January 2015 to present the millage to the voters in May 2015 for renewal. In addition, the Caddo Parish Commission has agreed to fund the Foundation's Entrepreneurial Acceleration Program in the amount of $500,000/year for five years between 2014 through 2018.

The Foundation took over the LSU Health and Sciences Center, a public hospital, and it is now a wholly owned subsidiary of the Foundation under the name University Health Center. The University Health Center has two clinics it runs, one in Shreveport and one in Monroe.

Law:
La. R.S. 42:1121A(1) provides no former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that former agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed advisory opinion.
