T. Baker Smith, LLC. provides services in the fields of Engineering, Surveying and Environmental planing among others. Mr. Poincon stated that if the Lafourche Parish Planning Commission has an vacancy he would like to be able to accept an appointment if offered. Mr. Poincon stated that he would recuse himself from participation and voting if his firm was to submit an item for the Planning Commission's approval. Further, Mr. Poincon added that he is an hourly employee of T. Baker Smith, LLC. and not an officer, director, trustee, or partner.

La. R.S. 42:1111C(2)(d) prohibits a public servant, from receiving any thing of economic value for services rendered to or for any person during his public service unless such services are neither performed for nor compensated by any person from whom such public servant would be prohibited by La. R.S. 42:1115(A)(1) or (B) from receiving a gift.
La. R.S. 42:1115B prohibits a public servant from accepting any thing of economic value from any person, if such public servant knows such person conduct operations or activities that are regulated by the public servants agency, and those who have a substantial economic interest that could be affected by the performance or non-performance of the public job duties.
