Consideration of a disqualification plan regarding Civil Service Director, Ellen D. Barrois, supervising Katherine E. Johnson, Ms. Barrois soon-to-be daughter-in-law, who is employed in her agency, the Plaquemines Parish Civil Service Commission.
Facts:
Ms. Katherine E. Johnson has been employed with the Plaquemines Parish Civil Service Commission since September 1, 2011. On June 9, 2014, Ms. Ellen Barrois was selected to replace Mr. William Paradelas as the Plaquemines Parish Civil Service Director. Ms. Barrois has been employed with the Commission since June 5, 1981. Ms. Katherine Johnson is engaged to Ms. Barrois son Matthew. The couple is planning on marrying January 23, 2016.

Ms. Barrois submitted a disqualification plan to prevent her participation in prohibited transactions. All employee evaluations, time sheets and other transactions that have a substantial economic interest involving Katherine Johnson will be forwarded to Civil Service Chairman DeeAnna Jurisic or in her absence the Vice Chairman Trevor Smith. Ms. Barrois stated that this plan has already been implemented and the Chairman will conduct Ms. Johnson's annual evaluation on September 1, 2016.

Law:
La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

La. R.S. 42:1112B(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.

La. R.S. 42:1112(C) allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code

La. R.S. 42:1119 A. No member of the immediate family of an agency head shall be employed by his agency.

La. R.S. 42:1119 C.(2) which provides for the continued employment of the immediate family member where the immediate family member becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employees immediate family member becoming the agency head.

Ethics Rules Chapter 14, 1404A The proposed disqualification plan procedure shall be implemented by the employee and his immediate supervisor, and the public employee shall otherwise refrain from participating from the potential transaction until such time as the board has, in writing, provided the public employee, his immediate supervisor, and his agency head with instructions as to the procedure to avoid participation in the prohibited transaction.
Recommendations:
Accept the draft disqualification plan.
