Advisory opinion request regarding whether Donnie Perron, a member of the St. Landry Parish School Board, can observe and evaluate teachers who are working for the St. Landry Parish School Board.
Facts:
Donnie Perron is an elected member of the St. Landry Parish School Board (School Board). He is also currently employed as a part-time adjunct professor with the University of Louisiana at Lafayette (ULL) and as an independent contractor with iTeach, an online teacher certification company based in Texas. As an adjunct professor with ULL, Mr. Perron observes and evaluates only those teacher candidates that are enrolled in a program offered by ULL. He also observes and evaluates other teacher candidates in his capacity as an independent contractor with iTeach. Neither ULL nor iTeach has a contractual relationship with the St. Landry Parish School System (School System).
Furthermore, iTeach does not have a contractual relationship with ULL, as the agreement is between the teacher candidate and either ULL or iTeach. Additionally, ULL and iTeach arrange for approval from the schools for Mr. Perron to enter the campus to observe the teacher candidates. Finally, his observations and evaluations of the teacher candidates, including any subsequent reports, are not submitted to nor are they reviewed by the School Board or anyone within the School System.

Law:
La. R.S. 42:1111C(2)(d) prohibits a public servant and a legal entity in which he exercises control or owns an interest in excess of 25% from receiving any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are neither performed for nor compensated by any person from whom he would be prohibited by R.S. 42:1115A(1) or B from receiving a gift.

La. R.S. 42:1115A(1) prohibits a public servant from soliciting or accepting, directly or indirectly, any thing of economic value as a gift or gratuity from any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that the person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency.

La. R.S. 42:1113A prohibits a public servant, a member of his immediate family, or a legal entity in which he has a controlling interest from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of his agency.

Recommendations:
Adopt the proposed advisory opinion.
