Advisory opinion request regarding whether payment for miles traveled to and from a board/commission meeting is considered "reimbursement of expenses for service on the board or commission."
Facts:
Act 450 of the 2015 Regular Session amended La. R.S. 42:1124.2.1D(1)(b) to exclude from the personal financial disclosure filing requirement any person who serves on a board or commission that does not have the authority to expend, disburse, or invest more than fifty thousand dollars of funds in a fiscal year and whose members are not eligible to receive any compensation, per diem, or reimbursement of expenses for their service on the board. The Louisiana Department of Agriculture and Forestry oversees numerous boards and commissions whose members are not eligible to receive any compensation or per diem, but are eligible to be reimbursed for their travel expenses.
Law:
La. R.S. 42:1124.2.1D(1)(b)(vi) provides that board or commission shall not mean a board or commission that does not have the authority to expend, disburse, or invest more than fifty thousand dollars of funds in a fiscal year and whose members are not eligible to receive any compensation, per diem, or reimbursement of expenses for service on the board or commission.
Recommendations:
Adopt the proposed advisory opinion.
