Advisory opinion request regarding whether Kenny Zulli may run for the office of Councilman, District D, in St. Bernard Parish while his wife owns and he is employed by The St. Bernard Parish Post.
Facts:
Uuntil November 2010, Kenny Zulli owned The St. Bernard Parish Post, a community newspaper. Mr. Zulli's wife is now the sole owner of The St. Bernard Parish Post and he still works for the newspaper. If Mr. Zulli were to be elected as Councilman, District D in St. Bernard Parish, The St. Bernard Parish Post would not accept advertisement from St. Bernard Parish Government or its entities.
Law:
La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

La. R.S. 42:1111C(2)(d) prohibits a public servant from receiving compensation for services rendered to any person who has a business, contractual or financial relationship with the public servant's agency.

Recommendations:
Adopt the proposed advisory opinion.
