Advisory opinion regarding whether Lorry Trotter may continue as the compensated Executive Director of the Retired State Employee's Association if he is appointed to the Louisiana State Employee's Retirement System (LASERS) Board of Directors.
Facts:
Lorry Trotter is the compensated Executive Director of the Retired State Employee's Association, a non-profit corporation. The relationship between the Retired State Employee's Association and the Louisiana State Employee's Retirement System (LASERS) is defined by statutory provisions and a Cooperative Endeavor Agreement between the two entities.

The Cooperative Endeavor Agreement recognizes that LASERS and the Association work jointly to inform retired state employees and active members of the benefits they receive from LASERS and the impact the changes to the plan would have on their interests.

The Association allows LASERS to be a part of its member newsletter, allows LASERS to make presentations at its meetings, and allows LASERS to have exhibit space. In return, LASERS provided information technology services and data to the Association. No funds are exchanged between the two entities.

When there is a vaccancy created on the LASERS board of directors that is occupied by a retiree, then the Association appoints a person to the LASERS board.

Law:
La. R.S. 42:1111C(2)(d) provides that no public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are: (d) Neither performed for nor compensated by any person or from any officer, director, agent, or employee of such person, if such public servant knows or reasonably should know that such person has or is seeking to obtain contractual or other business or financial relationships with the public servant's agency; conducts operations or activities which are regulated by the public employee's agency; or has substantial economic interests which may be substantially affected by the performance or nonperformance of the public employee's official duty.
Recommendations:
Adopt the proposed advisory opinion.
