Request that the board waive the $420 late fee assessed against Thomas Wesley Burns, a candidate for Judge 37th JDC in the November 4, 2014 election, for filing the 2014 Supplemental campaign finance disclosure report 7 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Tonya Burns, report preparer for Thomas Burns, states that she thought that she had completed the report and it was processed on time. She did not realize it was late until she received notification by mail. She says she was trying to catch up from the campaign. She is Mr. Burns' paralegal and wife and had many responsibilities at the time. She also stated that she is the main caregiver for her grandmother.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $200 based on future compliance. The fine is payable within 30 days or the suspended portion becomes due and owing.
