Advisory opinion request regarding whether the post employment restrictions would prohibit former Governor's Office of Homeland Security and Emergency Preparedness (GOSEP) employee Leanne Guidry from seeking employment with Sellers and Associates.
Facts:
Leanne Guidry requested an advisory opinion regarding whether La. R.S. 42:1121 would prohibit her, from seeking employment with Sellers and Associates, Inc. after she terminates her employment with the Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP). Ms. Guidry stated that she has been employed with GOHSEP since October 2006. Ms. Guidry has been offered employment as a Senior Project/Grant Manager with Sellers.

Ms. Guidry provided that Sellers and Associates does not have a contract, or financial relationship with GOHSEP, however Sellers does represent applicants in the Hazard Mitigation Grant Program. As part of Ms. Guidry's duties while employed with GOHSEP she served as the State Applicant Liaison for the applicants of the Hazard Mitigation Grant Program. In this position Ms.Guidry assisted applicants in preparing grant applications for funding from the Federal Emergency Management Agency (FEMA). Once GOHSEP has reviewed the applications and approved the content, the application moves forward in the application process. The application is not re-submitted to GOHSEP.

Ms. Guidry stated that while Sellers represents several of the applicants that she has assisted in the past as part of her duties as the State Applicant Liaison for GOHSEP, she will not participate with those applicants. Ms. Guidry has also provided that as an employee of Sellers she would not be providing the same service to the applicants as she did while employed for GOHSEP. Ms. Guidry stated that she will not work on any project she worked on during her public employment.
Law:
La. R.S. 42:1121B(1) No former public employee shall for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction or in an appearance in connection with a transaction in which such former public employee participated at any time during his employment and involving the governmental entity by which he was formerly employed, or for a period of two years following the termination of his public employment, render any service which such former public employee rendered to the agency during the term of his employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
Adopt the proposed advisory opinion.
