Assumption Parish Assistant District Attorney Michael P. Calabro requested an advisory opinion regarding whether the Code would prohibit Mr. Jeremy Pipsair from seeking contract work, through public bid or otherwise with the Water Works Board, the Drainage District, or Assumption Parish Government if Mr. Pipsair is appointed to the Assumption Parish Water Works Board. The Assumption Parish Police Jury would like to appoint Mr. Pipsair, owner of Laser Construction Inc., to the Assumption Parish Water Works Board.
Mr. Pipsair stated that neither he nor Laser Construction have any contracts with Assumption Parish Water Works. Mr. Pipsair added that Laser Construction has a contract with Assumption Parish to rebuild bulkheads. Mr. Calabro provided that the Drainage Districts in Assumption Parish are not under the jurisdiction or supervision of the Water Works Board.

La. R.S. 42:1113B prohibits an appointed member of any board or commission, a member of his immediate family, or legal entity which he has a substantial economic interest from bidding on or entering into or being in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.
