Answer submitted by Lydia Kingan, a former member of the Elizabeth Board of Aldermen, in response to a notice of delinquency.
Facts:
Lydia Kingan received a notice of delinquency on July 16, 2015, requesting that she file her 2014 Tier 3 Annual Personal Financial Disclosure Statement (PFD). Ms. Kingan, who served as a member of the Elizabeth Board of Aldermen until her term expired on December 31, 2014, submitted documentation showing that she completed her required ethics training for calendar year 2014. She did not submit any other information or documentation.
Law:
La. R.S. 42:1124.3 requires each person holding a public office who represents a voting district having a population of fewer than five thousand and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950, except any person who is required to file a financial statement by R.S. 42:1124, 1124.2, or 1124.2.1, to file a financial statement by May 15th of each year during which the person holds such office and the year following the termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to timely file, omission of information or inclusion of inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the filer that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such a failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Advise Ms. Kingan she has 7 business days to file a 2014 Tier 3 PFD.
