Request that the Board reconsider waiving the $600 in campaign finance late fee assessed against Phil Capitano, a candidate for Mayor, City of Kenner, Jefferson Parish in the March 27, 2010 Election, whose 2014 Supplemental campaign finance disclosure report was filed 16 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Philip Rebowe, as preparer for Phil Capitano, states that the report was filed timely but the Ethics website shows a report with the April 4, 1998 election date as having the 2013 supplemental report that was filed for the March 27, 2010 election. Pursuant to the Ethics website's directions, all reports were filed accordingly. However, the Ethics website has several errors concerning Phil Capitano, specifically the March 27, 2010 election reports are appearing under the April 4, 1998 election, such as not having a 2013 supplemental report for the March 27, 2010 election. He goes on to state that he is requesting any penalty be waived considering the confusion surrounding the report dates.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all based on future compliance.
