Waiver request submitted by James T. Strong Sr., Delhi Charter School, regarding a $1,500 late fee assessed for filing his 2013 Tier 3 Annual PFD 98 Days late.
Facts:
Mr. Strong states that he mailed his 2013 Tier 3 PFD in April 2014. This office never received the PFD, so a NOD was mailed to Mr. Strong in December 2014 and received by his Office Manager on January 2, 2015. Mr. Strong states that he received a certified letter in July 2014 and alleges the post office must have failed to deliver his pfd which prompted the letter. Mr. Strong states that he then sent his pfd to the headmaster of the charter school for mailing, which was not mailed until a year later in April 2015. However, according to staff records, no certified letter was sent to Mr. Strong in July 2014 for this pfd or any other pfd. The NOD was not sent until December 2014 and received in January 2015.

Mr. Strong goes on to state that he serves without compensation and he and his wife have given over $500,000 to the charter school for its buildings and tens of thousands of dollars for school uniforms and field trips. He is requesting that the fine be dropped as he knows this will be the greatest benefit to our office, the State, Delhi Charter School and him.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
