Waiver request submitted by David Edward Root, former member of the St. Tammany Parish Fire District #8, regarding a $150 late fee assessed for filing his 2013 Tier 2.1 Annual PFD 3 days late.
Facts:
Sandra Root, spouse of David Root, states that her husband is 78 yrs old and recovering from surgery and unable to deal with "additional stress, harassment and pressure." She states that Mr. Root filed his 2013 PFD in 2014 and again in February 2015. However, Ms. Root is referring to the 2012 pfd that was filed in January 2014 in response to a NOD they received. The NOD for the 2013 pfd was not issued until January 2015.

Allegedly, Mr. Root resigned from the Board after spending the last three years of his service trying to expel an incompetent and ineffective employee of the district. He also resigned because his efforts were needed at home to care for an ill family member.

Ms. Roots also asks for no more threats of retaliation against her husband. Staff takes exception to Ms. Root and her statement as no staff member has ever threatened Mr. Root with any retaliation.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
