Answer submitted by Louis Mann, Jr., a member of the Heymann Performing Arts Center Advisory Board, in response to a notice of delinquency.
Facts:
Louis Mann, Jr., a member of the Heymann Performing Arts Center Advisory Commission, received a notice of delinquency on August 20, 2015, requesting that he file a 2014 Tier 2.1 Annual Personal Financial Disclosure Statement (PFD).

Pursuant to Ordinance No. O-229-96, the Advisory Commission advises the Lafayette City-Parish Consolidated Government regarding the operation and maintenance of the Heymann Performing Arts Center & Frem F. Boustany Convention Center. The Commission has the power to interview make a recommendation regarding a manager of the Center whenever that position becomes vacant. The Commission also makes recommendations regarding the formulation of programs that it considers beneficial to the operation and maintenance of the Center.

Patricia Leyendecker, Director of the Community Development Department of Lafayette, confirmed that the Commission has no fiduciary responsibility or authority, nor does the Commission have a budget. The Commission is strictly advisory in nature.

Law:
La. R.S. 42:1124.2.1 requires each member and any designee of a member of a board or commission that has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year to file a financial statement by May 15th of each year during which the person holds such office and the year following the termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to timely file, omission of information or inclusion of inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the filer that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such a failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Advise Mr. Trent that he is not required to file a 2014 Tier 2.1 PFD.
