Advisory opinion request regarding whether Mr. Emeric Dupuy may serve on the Avoyelles Port Commission while he also serves as the Avoyelles Parish Assessor.
Facts:
Mr. Dupuy's term as Avoyelles Parish Assessor will end on December 31, 2016 as he states he will not seek re-election. He has been contacted to serve as an uncompensated commissioner on the Avoyelles Port Commission (Commission). The Commission and the town of Simmesport appoints the commissioners.
Law:
La. R.S. 42:1113A of the Code prohibits a public servant from entering into any transactions that are under the supervision and jurisdiction of his agency.
Recommendations:
Adopt the proposed advisory opinion.
