Reconsideration of the Board's suspension of all but $1,000 in connection with a waiver request submitted by O'Neal Jones, III, former member of the New Iberia City Council, regarding a $2,500 late fee assessed for filing his 2012 Tier 2 annual pfd 570 days late.
Facts:
Mr. Jones states his a 30 year old African American male trying to start a family. He states that he does not have the funds to pay the $1,000 reduced late fee.


Mr. Jones did take the Ethics Training in 2012, which covers the pfd filing requirements. Mr. Jones has been filing since 2011.


INITIAL INFORMATION


Mr. Jones states he was 26 yrs old when he ran for an unexpired term of office in April 2011. He states that the official who formerly held the office decided to run in the next election, and the former official was re-elected to office. Mr. Jones' term expired in January 2013. Mr. Jones states that he tried to file all reports that were required of him while he was in office for one year nine months. He also does not recall receiving the notice of delinquency. The name is unclear on the green card, but the same address was used for the Late Fee Order, which Mr. Jones personally signed for evidencing receipt.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Affirm the Board's decision to suspend all but $1,000 based on future compliance with the reporting requirements under the Code of Ethics. Offer a payment plan. If a payment plan is not entered into within 30 days or the reduced amount paid in 30 days, the full amount becomes due and owing.
