Advisory opinion request regarding whether Brian Montgomery may serve as Interim Fire Chief for the City of Winnfield Fire Department while serving as board member on the Winn Parish Fire District #3 Board (District).
Facts:
Brian Montgomery currently serves on the District Board. The District and Winnfield Fire Department are separate entities with different jurisdictions. The appointing authority for the city fire chief is the mayor of Winnfield and the Winnfield City Council.
Law:
La. R.S. 42:1113B of the Code prohibits an appointed member of a board or his immediate family member from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such appointed member.
Recommendations:
Adopt the proposed advisory opinion.
