Advisory opinion request from Terrebonne Parish Fire Protection District #10, Chief Quint Liner, regarding whether the Ethics Code would prohibit the continued employment of Captain, Bryan Hebert, since his father, Brian Hebert, was sworn in as a member of the Fire District Board in January.
Facts:
Chief Liner indicates that the Department's Captain, Bryan Hebert, has been employed with the Department for 13 years prior to his father, Brian Hebert, being appointed to the Fire Board. Additionally he provided that his Department would like to hire, Fletcher Lodrigue, the father of his daughter's child. They have never married and have an on and off relationship.
Law:
La. R.S. 42:1119B(1) states that no member of the immediate family of a member of a governing authority or the chief executive of a governmental entity shall be employed by the governmental entity.
La. R.S. 42:1119C(2) provides a limited exception to the general nepotism prohibition and allows the continued employment and normal promotional advancement of a public employee when a member of the public employee's immediate family becomes the agency head of the public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.

La. R.S. 42:1112 prohibits a public servant from participating in a transaction involving his governmental entity in which a member of his immediate family has a substantial economic interest.

Recommendations:
Adopt the proposed advisory opinion.
