Request to affirm an advisory opinion issued to Roy Mardis, a member of the Claiborne Parish Police Jury, regarding his employment with the Claiborne Parish's Detention Center, which is owned by the Claiborne Parish Sheriff's Office that was previously issued in Docket No. 2006-434.
Facts:
In Docket No. 2006-434, Mr. Mardis provided the following facts: (1) he has served as a member of the Claiborne Parish Police Jury for fifteen years; (2) he was recently elected to serve as the jury's Chairman and as such will serve as a signatory on the police jury's accounts; (3) he was also recently employed by the Claiborne Parish Detention Center, which is owned by the Sheriff's Office; (4) the Sheriff is elected and his department maintains its own budget; (5) the detention center is managed by a private company engaged by the Sheriff's Office; (6) he is considered to be an employee of the Sheriff's Office.
The Board determined that the Sheriff's Office constituted a separate agency, and therefore, his continued employment was not prohibited. Furthermore, since the Sheriff's Office is not a "person" under the Code, no participation issues are raised by Mr. Mardis signing checks to the Sheriff's Office to reimburse it for the costs of detaining parish prisoners.

Mr. Mardis now seeks to affirm the previous opinion advising that the Detention Center is now managed by the Sheriff's Department and not a private company, that he is no longer chairman and no longer has signatory authority on the checks issued by the Police Jury.

Recommendations:
Adopt the proposed advisory opinion.
