Waiver request submitted by Donald R. Warren, Kisatchie Delta Regional Planning and Development District, regarding a $600 late fee assessed for filing his 2013 Tier 2.1 Annual PFD 12 days late.
Facts:
Mr. Warren provides details to correspondence received in 2013; however, the issue at hand relates to a Notice that was issued in February 2015. Since staff has no record of any correspondence being sent to Mr. Warren in 2013, it is assumed Mr. Warren is referring to the correspondence received in February 2015. Mr. Warren states that he contacted his board for assistance and he was told to get the form from the Board's website. However, he does not have a computer. He stated he called this Board to obtain the form, but again was told to obtain the form from the website.

Mr. Warren's first pfd with this Board was a Tier 3 candidate pfd when he ran for office in the October 2011 election. He was then appointed to the present board, which required him to begin filing in 2013 (his 2012 pfd).

Mr. Warren states he is a retired veteran living on a retirement pension.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
