RE:
Advisory opinion request as to whether the Acadia Parish Police Jury may appoint Michael Habetz as a part-time board member of the Acadia Parish Planning Committee.
Facts:
The Acadia Parish Police Jury is considering appointing Michael Habetz as a part-time board member of the Acadia Parish Planning Committee. Mr. Habetz presently holds a full-time paid position with the Sixth Ward Crowley Drainage District. Mr. Habetz was previously appointed by the Acadia Parish Police Jury to a part-time position on the board of the Iota Long Point Gravity Drainage District in which he holds the position of chairman. Both of the part-time appointed positions that Mr. Habetz holds are paid a small stipend for attending the required meetings.
Law:
La. R.S. 42:1113 prohibits public servants, their immediate family members, or legal entities in which they have a controlling interest, from entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
