Patterson Mayor Rodney Grogan requested an advisory opinion regarding whether the Code of Governmental Ethics would prohibit the Chairman of the City of Patterson Planning and Zoning Commission, Tim McCann, or his company, St. Mary Realty, from purchasing surplus property located at 1231 Main Street in Patterson. Mayor Grogan provided that the land was adjudicated to the City due to lack of taxes by the owner. He stated that the Planning and Zoning Commission did not ever have supervision or jurisdiction over the surplus property. He added that Mr. McCann never participated as Chairman of the Planning and Zoning Commission on any transaction regarding the surplus property.

La. R.S. 42:1113B prohibits an appointed member of a board or commission, his immediate family member, or a legal entity in which they have a substantial economic interest, from entering into or being in any way interested in a transaction that is under the supervision or jurisdiction of the board or commission.
La. R.S. 42:1102(2)(a)(I) defines "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.
