Appearance in connection with a request to reconsider the Board's denial of a waiver request submitted by Whitney Laird (formerly Whitney Kling) regarding a $1,300 late fee assessed for filing her R.S. 42:1114 disclosure affidavit 13 days late.
Facts:
Ms. Laird asserts that the FAQs all state that the filing date for each Tier for financial disclosures in May 15th. However, Ms. Laird is not filing a financial disclosure statement pursuant to a Tier level, that is as an elected official or appointed board member, which is also clearly stated on the FAQs. Ms. Laird is filing as an immediate family who receives a thing of economic value from a person that contracts with her father's agency pursuant to R.S. 42:1114, not R.S. 42:1124, et seq.

Ms. Laird continues to quote information regarding a notice of delinquency that applies only to personal financial disclosure statements under R.S. 42:1124, et seq; not R.S. 42:1114 financial disclosures. Further, this is not Ms. Laird's first time filing.

INITIAL INFORMATION :


Ms. Laird was required to file a R.S. 42:1114 disclosure affidavit for receiving income from an entity that has a contractual relationship with her father's agency, the La State Bond Commission. The disclosure is required to be filed each year by May 1st disclosing information from the previous calender year. The 2013 disclosure was due to be filed on May 1, 2014. The legislature, during the 2014 legislative session, changed the due date to May 15th with the change becoming effective on January 1, 2015.

Ms. Laird filed her disclosure on May 14, 2014. Since the change in the law was not effective at that time, Ms. Laird filed her disclosure 13 days late.

Law:
La. R.S. 42:1114 provides that each public servant and each member of his immediate family who derives anything of economic value, directly, through any transaction involving the agency of such public servant or who derives any thing of economic value of which he may be reasonably expected to know through a person which (1) is regulated by the agency of such public servant, or (2) has bid on or entered into or is in any way financially interested in any contract, subcontract, or any transaction under the supervision or jurisdiction of the agency of such public servant shall disclose certain information as set forth in Section 1114.
Recommendations:
Affirm the Board's decision to decline to waive.
