Answer submitted by Howard Cannaday, Constable for Ward 2 in Catahoula Parish, in lieu of filing a personal financial disclosure statement in response to a notice of delinquency.
Facts:
Howard Cannaday, Constable for Ward 2 in Catahoula Parish, received a notice of delinquency on October 23, 2015, requesting that he file a 2014 Tier 2.1 Annual Personal Financial Disclosure Statement (PFD). Mr. Cannaday filed an answer that same day. He stated that he did not serve as a constable at any time during calendar year 2014. Nevertheless, he has served in his current position since January 1, 2015.
Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. However, if the holding of the office terminates in January, then he will not be required to file a financial statement the year following termination as long as he files a financial statement during the year in which the holding of the office terminates that includes the period he held the office that year.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Advise Mr. Cannaday that he has 7 business days to file a 2014 Tier 2.1 PFD.
