Ms. Patricia Douglas, the Court Administrator for the 23rd JDC requested an advisory opinion regarding whether the Code of Governmental Ethics would prohibit the Judges for the 23rd JDC of Louisiana from employing Mr. Hart Bourque as the Jury Commissioner for the 23rd JDC.
After decades of service as the elected Clerk of Court for Ascension Parish, Mr. Bourque, officially retired January 31, 2015. The 23rd JDC serves Ascension, St. James and Assumption Parishes. Ms. Douglas provided that the appointment of the Jury Commissioner is done by order of the Judges in accordance with Louisiana Code of Criminal Procedure Article 404. Further, Ms. Douglas added that the Ascension Parish Clerk of Court neither appoints nor compensates the Jury Commissioner.
