Advisory opinion request regarding whether former LSU employee Edwin Landry is prohibited from going to work for Waterproofing Products, Inc.
Facts:
Edwin Landry requested an advisory opinion regarding whether the post-employment restrictions found in La. R.S. 42:1121B(1) would prohibit him, a recently retired public employee, from going to work for Waterproofing Products, Inc. Mr. Landry retired as a Construction Manager with the Office of Facility Services at Louisiana State University on October 20, 2015. Mr. Landry stated that he was not an agency head and that he had no supervisory authority during his public service with LSU.
Mr. Landry provided that his duties included acting as a liaison for construction projects, attending pre-bid meetings, pre-construction meetings, progress meetings, inspections, reviewing change order request, reviewing applications for payments, coordinating construction schedules with various campus departments, and reviewing applications for project acceptance.
He added that if he accepts employment with Waterproofing Products, Inc., his duties would include promoting products from several manufacturers with designers, building owners and contractors for future construction projects. Mr. Landry stated that he would only work on new projects at LSU.

Law:
La. R.S. 42:1121 B(1) provides that no former public employee shall, for a period of two years following termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
