RE:
Advisory opinion request regarding whether Jerry Wyles may sell or install equipment to any police department, sheriff's office, fire department, or EMS company or persons employed by such agencies since he is employed by the Louisiana Department of Public Safety.
Facts:
Mr. Wyles is employed within the weights & standards agency within the patrol division of the Louisiana State Police. He has no supervisory duties nor is he employed by any other public agency. He would like to sell and install equipment such as lights, sirens, electronics, holsters etc. to police and fire departments, sheriff's offices and EMS companies through a company that he wholly owns called Wyles Police Store.
Law:
La. R.S. 42:1113A(1)(a) of the Code prohibits a public servant or immediate family member from bidding on or entering into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
