RE:
Advisory opinion request regarding whether former Twin Parish Port Commissioner Glen Crappel may enter into a settlement with the Port, within two years after his resignation, to resolve issues or claims against the Port.
Facts:
Property owned by Mr. Crappel, and adjacent to Port-owned property, began to have water back up on the property after the Port completed a boat landing and pavilion project. The Port sought to resolve this issue by instructing an engineer, Richard Primeaux, to render a recommendation on how to prevent the back up on not only on Mr. Crappel's property but other landowners affected by water back up. Mr. Primeaux recommended elevating portions of Mr. Crappel's property up to three feet and sloping towards ditches and storage on Port property.

Mr. Crappel resigned his position as a Twin Parish Port Commissioner on November 6, 2015 as a result of the Port being unable to rectify the situation. He has retained counsel to resolve the flooding issue allegedly created from the Port's construction. The Port anticipates that a settlement may potentially resolve the situation.

Law:
La. R.S. 42: 1121A(2) provides that no former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.
Recommendations:
Adopt the proposed advisory opinion.
