Request that the Board waive the $600 campaign finance late fee assessed against Robert Owsley, a candidate for 10th Judicial District Court Judge in the November 4, 2014 Election, and the campaign chairman and treasurer, Tommy Murchison and Nicole Howard, whose EDE-P campaign finance disclosure report was filed 12 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Robert Owsley states that as a candidate for judicial office he is directed by the Code of Judicial Conduct to refrain from most activities relating to her campaign account. Therefore, his committee member, Chadwick Melder, was responsible for filing his reports. Mr. Melder states that he attempted to file the EDE-P report early because Mr. Owsley had no expenditures. On his first attempt to file the report, he received a "fatal errors" message. On the second attempt, he received a success message, but he didn't realize there should have been a confirmation screen after this message. He states that had he known he had not filed properly, he would have immediately corrected it.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all based on future compliance.
