RE:
Request that the Board waive the $2,500 campaign finance late fee assessed against Senator Elbert Lee Guillory, a candidate for Lieutenant Governor in the October 24, 2015 Election, whose 180-P campaign finance disclosure report was filed 36 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, James Burland, attorney for Senator Elbert Lee Guillory, states that the 180-P campaign finance report was late because during the time that the transactions occurred and prior to the deadline for the 180-P report, the campaign bookkeeper was dismissed due to large discrepancies found within the accounting practice. Immediately upon realizing that the 180-P report was late, Senator Guillory hired Burland and Associates to prepare and file the report and ensure that all future reports would be filed within a timely manner.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
