RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Thomas J. Capella, a candidate for Jefferson Parish Assessor in the October 24, 2015 Election, whose 180-P campaign finance disclosure report was filed 31 days late.
Facts:
In connection with her request that the Board waive the late fee assessed for the late filing of the report, David Sherman, report preparer for Thomas Capella, states that during the period covered by the 180-P report, no contributions were received and no expenditures were made. As a result of this lack of activity, the Committee's treasurer mistakenly believed that the 180-P report did not have to be filed. Also, the Notice of Delinquency that was sent to Mr. Capella was dated May 1, 2015, but it was not delivered until May 18, 2015.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all but $300 based on future compliance.
