Answer submitted by Henrietta Byrd, a former Natchez Board Alderman, in response to a notice of delinquency regarding her 2014 Annual Tier 3 Personal Financial Disclosure statement.
Facts:
Ms. Byrd received a notice of delinquency on October 26, 2015, requesting the she file her 2014 Tier 3 annual personal financial disclosure statement. An answer was timely filed by Ms. Byrd stating that she resigned her alderman position on July 1,2014. She believes she is not required to file because of this resignation.
Law:
La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

La. R.S. 42:1124.3 requires each person holding a public office who represents a voting district having a population of fewer than five thousand and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950, except any person who is required to file a financial statement by R.S. 42:1124, 1124.2, or 1124.2.1, to file a financial statement by May 15th of each year during which the person holds such office and the year following the termination of the holding of such office.

Recommendations:
Inform Ms. Byrd that she has 7 business days to file the required 2014 Personal Financial Disclosure statement.
