RE:
Request that the board waive the $1,000 late fee assessed against Joseph H. Riley, II, a candidate for Lafayette City Court Judge, Division A in the November 4, 2014 election, for filing the 10-G campaign finance disclosure report 36 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Joseph H. Riley, II, states he complied with filing deadlines and electronically submit reports on time and early in some cases.
No Notice was received to think other than all reports were filed in a timely matter. Received Certified mail on December 30, 2014, of letter dated and post marked for November 21, 2014, with the address of P.O. Box 51884, Lafayette, LA. The envelope had a forwarding address of 715 St. Thomas Street, Lafayette, LA, which was the Notice failure to file 10-G Report. Mr. Riley understood that only applied to candidates that participated in the primary election who were now participating in the general election. Mr. Hunter and his committee had filed and reported all contributions for the entire election didn't think the 10-G applied to him.

He called the Ethics Board and spoke to Cheryl, whom informed him that all candidates were required to file the 10-G, and that given the lack of notice, prompt efforts and actions to mitigate the consequences and given the fact that the assessment penalty is more than 36% of his total contributions for the entire election the fine should be waived.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Suspend all based on future compliance.
