RE:
Request that the Board waive the $1,500 in campaign finance late fees assessed against Frank "Frankie" Howard, a candidate for State Representative, District 24, in the October 24, 2015 Election, whose 10-P report was filed 7 days late.
Facts:
In connection with his request that the Board waive the late fee assessed for the late filing of the report, Kathy Brunkhardt states report was submitted on October 7, 2015, but did not receive an email verification after submitting report. She contacted Campaign Finance office, was told that reports were there, showing file date of October 7, 2015.


Upon receipt of the letter yesterday, she called Campaign Finance Office, was told the system does not show that it was received and that is why the Notice of Delinquency letter was generated. She explained to her that she was told that reports showed as being filed. She was told to resubmit the report and make sure got a receipt showing it was received. She resubmit the report and received an email confirming receipt by ethics.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
Recommendations:
Waive the late fee.
