Advisory opinion request regarding whether the Academy of Training Skills is a governmental entity and/or public servant subject to the Code of Governmental Ethics.
Facts:
Pursuant to La. R.S. 40:2852, the Academy of Training Skills (ATS) is a judicial agency referral residential facility. As such, it is regulated by the Department of Public Safety and Corrections (Department).

Candidates for the pretrial diversion program are screened by a referring agency within the Criminal Justice System (i.e., District Attorney's Office, Judges, or the Department's Probation and Parole). Thereafter, ATS provides housing, clothing, meals, transportation, employment, counseling, and education to pretrial diversion program participants. ATS is self-funded through participant tuition payments.

Law:
Rule 101 provides that "affected person" means any person or governmental agency, or the authorized representative of such person or agency with a demonstrable and objective interest in the Board's interpretation, construction, and application of any law within the Board's jurisdiction.

Rule 601A provides that the Board shall receive requests for advisory opinions filed with it by affected persons. Requests for advisory opinions shall be in writing, state the name and address of the person requesting the advisory opinion, disclose his interest in the question presented, state the governmental agency and/or individual involved, specifically describe the transaction involved, be signed by the person making the request, and state sufficient facts to enable the Board to respond. The Board may decline to render an opinion with regard to any such request.

Decline to render an advisory opinion.
