Advisory opinion request regarding whether the Code of Governmental Ethics would prohibit Mr. Darrin Richard's sons from being hired as lifeguards by the Cameron Parish Department of Recreation while Mr. Richard serves as a board member of the Cameron Parish Recreation Department.
Facts:
Cameron Parish Councilman Davy Doxey requested an advisory opinion regarding whether the Code of Governmental Ethics would prohibit Mr. Darrin Richard's sons from being hired as lifeguards by the Cameron Parish Department of Recreation while Mr. Richard serves as a board member of the Cameron Parish Recreation Department. Mr. Doxey provided that Mr. Richard would recuse himself on any matter regarding his sons' employment. Mr. Richard has two sons, Devon and Brayden Richard, who would like to be employed by the Cameron Parish Recreation District as lifeguards.
Law:


La. R.S. 42:1102(3) defines agency head to mean the chief executive or administrative officer of an agency or any member of aboard or commission who exercises supervision over the agency

La. R.S. 42:1119 A provides that no member of the immediate family of a an agency head shall be employed in his agency.

Recommendations:
Adopt the proposed advisory opinion.
